Bus terms and conditions

Please read these Terms & Conditions carefully before purchasing. By purchasing a bus ticket, you are agreeing to be bound by the following Terms & Conditions.

1.0 Definitions
ATR means Auckland Thoroughbred Racing Inc.

Ticket means a bus ticket provided by ATR to transport raceday guests to Pukekohe Park Racecourse from Ellerslie Racecourse and return.

2.0 Agreement
2.1 Bookings are subject to the availability of the Tickets and will not be reserved or confirmed until online purchase and full payment is received in accordance with these Terms & Conditions.

2.2 Tickets are non-refundable once purchased, subject to these Terms & Conditions and any obligations ATR owes to any consumer under applicable consumer law.

2.3 ATR reserve the right to cancel the bus transportation option due to insufficient numbers if required or any other valid reason.

3.0 Payment
3.1 All bookings for Tickets must be accompanied by full payment in the form of direct credit or by credit card.

3.2 GST will apply to all goods and services supplied where applicable. Prices are in New Zealand dollars and include GST unless otherwise stated.

3.3 All Tickets must be utilised within the timeframes as stipulated by ATR.

4.0 Health and Safety
4.1 The Health and Safety at Work Act 2015 requires visitors / patrons to take reasonable care that their actions (or lack of action) do not put themselves or others at risk and to follow any reasonable health and safety instructions given to them by ATR.

5.0 Use of facilities
5.1 The bus schedule will be communicated to you 2 weeks out from the Raceday event. The departure time From Ellerslie Racecourse will be 1 hour prior to Raceday Hospitality precincts opening times and will leave Pukekohe Park 30 mins after the last race.

5.2 The serving and consumption of alcohol is prohibited on the bus.

5.3 ATR is not responsible for ticket holders missing the bus and will not refund ticket holders in the event of missing the bus.

5.4 ATR reserves the right to cancel tickets and provide a full refund minus the booking fee in the event not enough tickets are sold to warrant the cost of a bus.

5.5 ATR are not responsible for any delays caused by the bus company or delays due to high traffic volumes.

6.0 Issue of tickets

6.1 All tickets are e-tickets, meaning you can print at home when suits. Alternatively, you can show your ticket on the day via your phone provided your screen is in good condition.

6.2 ATR will not accept responsibility for misplaced, lost or stolen tickets previously issued. Any replacement tickets will be issued at the sole discretion of the ATR, and ATR reserves the right to charge for the replacement of any tickets issued.

​7.0 Display of tickets
7.1 Correct ticketing must be displayed at all times and/or on request. Failure to comply will result in entry being refused or removal from the bus.

8.0 On selling
8.1 You may not on-sell your ticket. Tickets found to be on-sold will be cancelled.

9.0 Conditions of entry
9.1 ATR has the right to deny entry onto, or remove ticket holders from a bus where ATR has reasonable grounds to do so, including any breach of these Terms & Conditions, including, but not limited to, intoxication, being under the influence of illicit drugs, being inappropriately attired or deemed by management to be adversely affecting the enjoyment of others.

9.2 You may be required to consent to a search of your person and/or possessions before boarding the bus, and an identification check at any time. Any refusal may see you refused entry to the bus. No refund of any part of any ticketed event or activity will apply.

9.3 Entry onto the bus may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from ATR directly.

10.0 Alterations to the Raceday
10.1 If any part of the Raceday including, without limitation, a race meeting, any race, performance or event is cancelled, abandoned or postponed, in whole or in part, due to adverse weather or for any other reason whatsoever that is beyond ATR’s control, there is no right to refund or exchange and no obligation is assumed by ATR for the arrangement of a substitute event, performance or any other element.

10.2 Under no circumstances will ATR be liable to you if ATR is unable to perform its obligations under these Terms & Conditions due to any event or cause beyond the reasonable control of ATR.

​11.0 Covid-19
11.1 You agree that your information may be held by ATR for the purposes of COVID-19 contact tracing and may be disclosed to the Ministry of Health should the need arise. By purchasing Tickets and Hospitality Packages and attending a Raceday at a Venue, you agree to comply with:
(a) any COVID-19 conditions of entry for the Venue in place from time to time;
(b) any reasonable request from ATR to undertake contact tracing at the Venue; and
(c) any Government or local government notice, regulation, law or guidance in connection with contact tracing or other public health requirements.

11.2 If the Raceday cannot be held as planned on the originally scheduled date due to a pandemic or epidemic event, including COVID-19 and including as a result of a Government notice, regulation, law or guidance affecting the operation of the Raceday, limiting the number of attendees at Raceday, or affecting the operation of any event, performance, or other activities at the Raceday, then ATR will use its best efforts to reschedule the Raceday and all tickets will be transferred to the rescheduled date. If ATR cannot reschedule the Raceday then ATR will cancel the Raceday, and you will be entitled to a refund of the ticket price you have paid for the ticket(s) less booking fee and any reasonable costs incurred by the Operator in connection with the Raceday Event which the Operator cannot recover.

11.3 The Operator will not be liable for any delay or failure or inability to observe or perform any of its duties or obligations under these Terms & Conditions if that delay or failure arises from a pandemic or epidemic event, including COVID-19 and including as a result of a Government notice, regulation, law or guidance affecting the operation of the Raceday.

12.0 General
12.1 All representations and warranties, whether expressed or implied are excluded to the maximum extent permitted by law. Nothing in these Terms & Conditions affects a Client’s rights under applicable consumer law, to the extent that the Client is a consumer for the purposes of the Consumer Guarantees Act.

12.2 These Terms & Conditions are governed by New Zealand law and the parties agree to submit to the exclusive jurisdiction of the courts of New Zealand.

12.3 ATR may collect personal information from you, and if it does so, it will collect and store that information in accordance with the ATR Privacy Policy available on Pukekohe Park’s website. Contact details provided when purchasing Tickets and Hospitality Packages can be used by ATR and provided to New Zealand Thoroughbred Racing for promotional, marketing and research purposes.
